ELMIRA TOWNSHIP

DECEMBER 8, 2005

 

A regular meeting of the Elmira Township Board was held on December 8, 2006 at the township hall commencing at 7:00 p.m. with Supervisor, Diane Franckowiak calling the meeting to order with the Pledge of Allegiance.

 

All board members present with the exception of Diane Purgiel who was excused.  Assessor, Jill Kassuba and Mr & Mrs Ron Geiger were also present.

 

Leonard made a motion to accept the minutes as read.  Seconded by Theresa and carried.

 

ORDINANCE OFFICER REPORT:

Ron reported that he was contacted by attorney, Peter Wendling in regard to the Northern Land Company violation. He is waiting for an answer from Peter if there is a conflict of interest on his part and if not will proceed.

 

PLANNING COMMISSION:

The PC would like to know what action can be taken on the burned Zaremba building in Elmira.  Dorothy Layman is the contact person for Otsego County.

The budget for 2006 will be $14,750.00.  The increase of $1,615.00 is for projected work on developing the draft ordinance language to match the master plan.

 

ASSESSOR'S REPORT:

No land divisions.  Jill reported that she has 100 computerized photos, there are seven December BOR corrections.  The appraisal study lists Commercial at 46%; Ag at 45% and Residential at 49%.  Jill made improvements to the Parcel Division Application.

Theresa made a motion to pay the bills.  Seconded by Leonard and carried.

 

OLD BUSINESS:

Leonard made a motion to pay registration fees, mileage and wages for BOR members, Supervisor and assessor to attend the training on February 23, 2006 in Grayling.  Seconded by Theresa and carried.

 

Leonard made a motion to pay wages for Sue to attend the free seminar sponsored by Keskine, Cook, Miler & Alexander, LLP on December 14, 2005.  Seconded  by Theresa and carried.

 

The next township association meeting will be held at Bagley on January17, 2006.

NOVEMBER 10, 2005

 

A regular meeting of the Elmira Township Board was held on November 10, 2005 at 7:07 p.m. with Clerk, Susan Schaedig calling the meeting to order with the Pledge of Allegiance.

 

All members present with the exception of Supervisor, Diane Franckowiak who was excused.  Ron Geiger, Ordinance Officer was also in attendance.

 

The meeting was turned over to Leonard to chair.

 

Diane P. made a motion to approve the October minutes.  Seconded by Theresa and carried.

 

ORDINANCE OFFICER REPORT:

Ron stated that he has issued citations to Northern Land Company, the owner of the house on M32 in Elmira and has never received an answer.  The board directed him to turn the problem over to the township attorney.

 

ASSESSOR'S REPORT:

Jill was excused.  There was one Land Division, Randall Webber.

 

PLANNING COMMISSION:

Leonard provided township board members with a copy of the PC's By-Laws.

He stated that the PC dropped plans to form a DDA and will continue to investigate forming some other authority.

 

The PC will meet on December 6, 2005 which will combine the November and December meetings due to the holidays.

Leonard made a motion to rescind his motion on September 8, 2005 to adopt Ordinance No 2 of 2005(Cable System Franchise Ordinance).  Seconded by Theresa and carried unanimously.

 

Theresa made a motion to adopt Ordinance No 2 of 2005, Cable System Franchise Ordinance which grants a non-exclusive franchise to CC VIII operating, LLC, DBA Charter Communications in Elmira Township to use local public ways and transact a local cable system business in the township.  Seconded by Leonard Skop and carried unanimously.

A regular meeting of the Elmira Township board was held on October 13, 2005 at the Elmira Township Hall commencing at 7:00 p.m. with Supervisor, Diane Franckowiak calling the meeting to order with the Pledge of Allegiance.

 

Board members present were Supervisor, Diane Franckowiak, Clerk, Susan Schaedig, Treasurer, Diane Purgiel, Trustee, Theresa Plachta and Trustee, Leonard Skop.

Others attending were Don Cherry, Jill Kassuba and Rocky Wright.

 

Diane P. made a motion to accept the minutes as presented.  Seconded by Theresa and carried unanimously.

 

PUBLIC COMMENT:

Don Cherry thanked the township for cleaning up the mess in the Village of Elmira.

 

ASSESSOR'S REPORT:

Working on one Land Division for October(awaiting completed application and fee.

 

PLANNING COMMISSION REPORT:

The PC decided not to support Conditional Rezoning at this time and would like to know how the township board stands on this issue.  Discussion followed.

 

Diane P. made a motion to approve the amended By-Laws of the  Planning Commission.  Seconded by Theresa and carried.

 

FIRE AUTHORITY

Diane F stated that the Fire Authority will not be receiving any FEMA funds this year and the ambulance has not yet arrived.

NEW BUSINESS:

Leonard made a motion in the form of a resolution to transfer ownership of  a 2005 Class C licensed business with Dance Permit, located at 50l Underwood, Elmira, Michigan 49730, Elmira Township, Otsego County from Czykoski's, Inc to Elmira Assets, Inc.. Seconded by Diane Purgiel and carried unanimously.

Diane reported that she will not be at the November meeting and appointed Leonard to run the meeting.

 

The board discussed allowing other governmental entities the use of the hall at no cost on an occasional basis.

 

The next Township Association meeting will be held on November 1 at the Gaylord Fire Hall.

 

The board received three sealed bids for the 2005-2006 snowplow season.

A & D Snow & Landscape, Mark's Handyman Service and D & H Excavating.

 

After reviewing the bids Leonard made a motion to accept D & H Excavating's bid for the 2005-2006 season.  Plow township and fire hall  $43.00/hr.  Tractor & blower to move snow piles or deep snow $55.00/hr.  Seconded by Theresa and carried unanimously.  Proof of Insurance to be provided.

 

Diane P made a motion to allow any board member to attend the MTA convention in January.  Registration, wages, hotel accomadations, $100.00 meal allowance and mileage to be paid by the township.  Seconded by Diane Franckowiak and carried unanimously.

A regular meeting of the Elmira Township board was held on September 8, 2005 at the Elmira Township Hall commencing at 7:04 p.m. with Supervisor, Diane Franckowiak calling the meeting to order with the Pledge of Allegiance.

 

Board members present were Supervisor, Diane Franckowiak, Clerk, Susan Schaedig, Treasurer, Diane Purgiel, Trustee, Leonard Skop and Trustee, Theresa Plachta.  Others attending were Assessor, Jill Kassuba, Ordinance Officer, Ron Geiger, Dorothy Layman, Jeff Ratcliff, Sally Skop, Matt Dobzrlewski and Carl Essenmacher.

 

Diane P. made a motion to accept the minutes as read.  Seconded by Theresa and carried.

 

PUBLIC COMMENT:

Dorothy Layman reported that Jerry Kyles' motion was denied by Judge, Patricia Morse and a court order was issued to clean up his property.  Elmira Township will be responsible for the clean up bills and can recoup costs on the sale of anything that violates the ordinance.

 

Leonard made a motion to allow Dorothy Layman and Richard Edmonds of Otsego County to co-ordinate a cleanup of Jerry Kyles' property with the expenses paid by  Elmira Township.  Seconded by Theresa and carried unanimously.

 

The Sheriff's Department, County Animal Control, Diane F. and Leonard will also be on site.  The whole process will be video taped.

 

Jeff Ratcliff explained that a DDA is a valuable tool but there a lot of obligations.  He stated that there are different avenues available and his office would assist the township.

 

ASSESSOR'S REPORT:

Jill reported that she is working on the Kotwicki Land Division, 6070 M-32 W 060-021-400-025-00 and awaiting a completed application and fees from Donald Walther-3420 North Townline  060-013-400-010-00.

 

Jill returned the 35mm camera to Sue and was issued a new digital camera.  The old computer case, books and papers were also handed over.

 

Michigan Tax Tribunal cases:  Fred Britt, Norbert Skibinski, Great Lakes Energy Corp and Wolverine Power.  No changes in status.

 

ORDINANCE OFFICER REPORT:

Ron reported that there are two complaints on M-32.  One has been satisfied and he is working on the other.

 

PLANNING COMMISSION:

Leonard made a motion to accept the PC's improvements to the Internal Procedures, Billboard Application Review.  Seconded by Diane P and carried unanimously.

 

FIRE AUTHORITY:

Diane F. recommended Carl Essenmacher be reappointed to the Fire Authority.

 

Leonard made a motion to reappoint Carl Essenmacher to the Elmira-Warner Fire Authority for a three year term.  Seconded by Theresa and carried unanimously.

 

The Authority has received a 1994 diesel ambulance through Warner Township from Antrim Ambulance Authority for a dollar. 

 

Diane P. made a motion to send the registration along with fees for a workshop on "The Nuts & Bolts of Fire Departments" for the Fire Authority.  Seconded by Leonard and carried unanimously.

 

The workshop is sponsored by the MTA and the Authority is not a member.  Reimbursement will be made to the township.

 

Firefighters are selling raffle tickets so that they may purchase a Thermal Imaging Camera.

Since Elmira Township is bound by a contract with Waste Management the board will continue using their services at 52.50 per month until August, 2008.  A 90 day notice is required at that time or the contract will continue for another year.  Waste Management promised to send notice.

 

Diane F and Sue traveled all the roads in Elmira Township to check on their condition. Mt. Jack and North Camp Ten are badly deteriorated.

 

NEW BUSINESS:

Theresa made a motion to accept the figures from Bill Kerr of Otsego County Equalization on form L-4029.  Allocated .8930, Voted Fire Operating .9884.  Seconded by Diane P and carried unanimously.

A regular meeting of the Elmira Township Board was held on August 11, 2005 at the township hall commencing at 7:05 p.m. with Supervisor, Diane Franckowiak calling the meeting to order with the Pledge of Allegiance. 

 

All board members present. Assessor, Jill Kassuba was excused.  John Ernst, Matt Dobzrlewski and Rocky Wright were also present.

 

John Ernst spoke to the board regarding the purpose, development and goals of a Downtown Development Authority(DDA).  He explained that if Elmira and Warner each created their own DDA it would have more influence.

 

Matt invited John to attend the Warner Township meeting to explain a DDA to his board.

 

Theresa made a motion to accept the minutes of July, 2005 as presented.  Seconded by Diane P. and carried.

 

Diane F. introduced Rocky Wright as the new handyman for Elmira Township.

 

FIRE AUTHORITY REPORT:

Diane F. reported that the FA approved a non-smoking policy.  Officers for the fire department are Ken Figiel, Chief;  Ed Coon, Ass't Chief and Diane Franckowiak, EMS co-ordinator.  There are two additional persons on the department staff.

Leonard made a motion to allow Theresa to have the assessor's old laptop computer.  Seconded by Diane F and carried.  Theresa abstained.

 

A new stove had to be purchased to replace the old one in the township hall since it was a hazard and had been red tagged.

The garbage pick-up contract for Waste Management has come up for renewal.  Diane P made a motion to contract with Arrow Sanitation at 60.00 a month for future trash pick-up.  Seconded by Leonard and carried unanimously.

 

Diane P made a motion to contract with Holton's LP Gas until May 31st 2006 at $1.249 per gallon fixed price for the township hall.  Seconded by Theresa and carried.

 

A new flag and six new tables have been purchased for the hall.

 

NEW BUSINESS:

The board discussed the Otsego County Land Use Services request for a contribution to help raise matching funds for a grant that will provide planning and technical support to manage urban sprawl, encourage urban redevelopment and coordinate land use throughout the county.

 

Leonard made a motion to contribute $334.00 towards the match for the grant project which will help the county update the county wide master plan.  Seconded by Theresa and carried.

A regular meeting of the Elmira Township board was held on July 14, 2005 at the Elmira Township hall commencing at 7:00 p.m. with Supervisor, Diane Franckowiak calling the meeting to order with the Pledge of Allegiance.

 

Board members present were Supervisor, Diane Franckowiak, Clerk, Susan Schaedig, Treasurer, Diane Purgiel and Trustee, Theresa Plachta.  Trustee, Leonard Skop was excused.  Others attending were Jill Kassuba, Ron Geiger, Mr. & Mrs. Dale Burger, John McLelan and Daryl Ferrier.

 

Theresa made a motion to accept the minutes as corrected. Seconded by Diane Purgiel and carried.

 

Darrell Currier and John McLalin, applicants for the handyman position attended the board meeting.  The board explained the expectations of the position and that the person selected could possibly start before the next board meeting in August.  They were asked to submit a per hour charge.

 

PUBLIC COMMENT:

Mr. & Mrs. Chris Burger of Burdo Road stated that they have been directed by the Otsego County Road Commission to call the township in regard to general maintenance of Burdo Road ie fixing of sand holes. 

 

Board members will attend a road commission board meeting to discuss the problems and condition of roads in Elmira Township.

ORDINANCE OFFICER REPORT:

Ron reported that he has two complaints on M-32 and the one on Stonycroft has been resolved.

 

On 6-14-2005 the court ruled against Jerry Kyles.  Judge Morse ordered the County to clean up.

 

Ron stated that Dorothy Layman was a great help in achieving the clean up.

 

PLANNING COMMISSION REPORT:

There will be no meeting in July.  The Master Plan will be placed on the township website and Hoffman will work with Diane F. to put a press release in the local paper making the public aware that it is finalized and accessible on the home page.  The township board will receive copies of the master plan.

The board discussed the Invoice Statement from the Otsego County Veteran Affairs.  A motion was approved at the Elmira Township June 2005 meeting to participate equally with the City of Gaylord and the other townships for 2006 flag expenses.  The 284.72 bill will not be paid since it was not a pre-approved expense.

 

Sue made a motion in the form of a resolution to support the construction of a new at-grade crossing and interchange at Milbocker and McCoy Roads, a new overpass to reconnect VanTyle road to South Wisconsin and improvements to local roads to support these new crossings.  To ask our elected state and federal officials help us secure the necessary state and federal funding to construct these projects.  Seconded by Theresa and carried.

The board discussed this issue and since Elmira Township has spent money working on its own master plan it was decided not to contribute. 

The request for funds for matching grant monies for the master plan work to continue will be discussed at the Township Association meeting at Dover on July 19th at 7:00 p.m.

Diane spoke with Dorothy Layman in regard to the Quality Plumbing business on Alba Road.  Dorothy stated that the owner had drawn a homeowner’s permit but the business out front definitely looks like a business.  She sent a letter and is awaiting an answer.

 

Dorothy issued a first citation to Jerry Kyles.  She stated that he is operating a junkyard.  He has fifteen days to reply.

 

Diane reported that the Fire Authority is working on a FEMA grant for a fire truck and she has spoken with Jeff Ratcliff in regard to money for buildings for the fire department.  There will be a USDA meeting on 3-22-05 at 1:00 p.m. on this issue.

 

Diane has the procedures for issuing citations.

ORDINANCE OFFICER REPORT:

Ron reported that he had spoken with Richard Edmonds in regard to the issuing of civil infraction citations for the ordinances. Ron stated that he had a difficult time contacting Mr. Edmonds and that he still doesn’t have sufficient information on the follow up of these citations.  The board directed Diane F. to contact township attorney, Bryan Graham as to how to handle citations.

 

Ron followed up on the boarded up house on Townline and  felt that the people had just left for the winter.  He received complaints on two other parcels but will wait until the snow melts.

 

PLANNING COMMISSION:

Leonard reported that the PC would like the opinion of the board regarding wind towers in Otsego County.  They had discussed the acceptance of the billboard applications and fees and felt that the Clerk should receive them since the position is bonded.

 

OLD BUSINESS:

Diane F. will attend the Circuit Court Pre-Trial for Linda Gault on the vacation of property by Elmira Township.  The court date is March 8, 2005 at 9:45 a.m..

 

NEW BUSINESS:

Diane F and Leonard attended the meeting with the Road Commission.  The RC does not plan on doing any work on North Camp Ten or Mt. Jack Road due to lack of funds.  Mr. Roper will get an estimate for part of Mt. Jack road but the township would have to pay for the improvement.

 

Elmira Township will host the Otsego County Officer’s Association meeting on March 15, 2005.

 

Leonard made a motion to accept the Gaylord Community Schools agreement for collection of summer school property taxes at $2.50 per parcel.  Seconded by Theresa and carried.

 

Leonard made a motion to rescind his motion made on January 13, 2005 declining to administer school elections.  Seconded by Theresa and carried.

 

Leonard made a motion to increase the board wages by 3% excluding summer tax collection.  Seconded by Sue and carried.

ASSESSOR’S REPORT:

December Board of Review was closed on December 31, 2004 with one final homestead correction.

 

Received a call from the State Tax Commission that the L-4029 Form should be rounded down.  Made adjustments to working copy for a start base for next year.  Jill sought advice on how to process the August, 2004 Fire Mileage election.  She will send a copy of the ballot wording to the state.

 

Jill presented an update on the Wolverine Power v Elmira Township, #0276843.  She has spent at least 100 hours so far on this tribunal case.

 

Filed Forms L-4408, L-4408a, L-4414, L-4016, L-4013, L-4412 Assessing Officer’s Report of Property Taxes levied for Revenue Sharing and related forms with the State Tax Commission on December 1, 2004.

 

Finishing up a few more building permits.  All deeds and homestead forms are current and maintained as they come in.  2005 Work roll is almost ready to add new buildings in and land values are being established and reviewed from the Equalization Department sales study.

 

Eighty Six Personal Property Statements and twelve buildings/towers on leased land were sent out on January 12, 2005.  They have started to come in.

 

Jill is seeking the value Equalization charges to print Personal Property Statements and Assessment Change Notices per parcel.  She is checking on alternatives which may be cost effective.

 

There were no Land Divisions.

 

ORDINANCE OFFICER’S REPORT:

Sue reported that Richard Edmonds will assist Ron with the Northern Land citation.  The citation had been sent out certified mail but has been returned.  The board discussed sending out future citations both certified and regular mail and stating on each copy that had been done. 

 

Ron is working another complaint made by Tom Long.

Diane P. made a motion to adopt an ordinance to amend the Elmira Township Bill Board Ordinance, being Ordinance No. 1 of 2001. Section 5a to read:  A person desiring to erect or maintain a billboard visible from a primary highway shall submit an application for a billboard permit to the township planning commission, or its designated representative, and shall pay the required permit application fee as established by resolution of the township board. Section 9 to read:  The township planning commission chairperson or other person designated by the township planning  commission is hereby designated as the authorized official to issue municipal civil infraction citations directing alleged violators of this Ordinance to appear in court.  Seconded by Leonard and carried unanimously.

Diane F. reported that she had informed Lee Curry that his appointment was up in September, 2003 and had not been reappointed at that time for a three year appointment.  He decided to resign since his job was interfering with attending the meetings.  Diane F. recommended Sean Mason as a replacement.  Carl Essenmacher’s appointment will be completed in September, 2005.

 

Leonard made a motion to appoint Sean Mason to the Elmira-Warner Fire Authority as a replacement for Lee Curry until September, 2006.  Seconded by Theresa and carried unanimously. 

 

NEW BUSINESS:

Susan made a motion to pay $100.00 to the Marquette County Township Association for bus fee transportation for Diane F and mileage to Diane P for the trip to the MTA convention in Detroit.  Seconded by Leonard and carried unanimously.

 

Susan made a motion to pay Diane P and Diane F expense money of $100.00 each and wages for the MTA convention in Detroit.  Seconded by Leonard and carried unanimously.

 

Leonard made a motion that Elmira Township declines to hold school board elections.  Seconded by Theresa and carried.

 

Susan made a motion in the form of a resolution to apply to the Secretary of State for a grant to purchase an optical scan voting system in 2005 and related Election Management System(EMS) software to comply with the Help America Vote Act(HAVA).  Seconded by Diane P and carried unanimously.

The board received an invitation from the Otsego County Road Commission to an annual meeting to share concerns, wishes and work the board would like to seen in 2005.  One hour has been set aside for each township on Feb 8th and 21st at 9:00, 10:00 and 11:00 a.m. and March 7th if needed.

 

Susan made a motion to amend the General Fund Parks and Recreation $545.00 to come from the fund balance.  Seconded by Diane P and carried unanimously.

 

The Township Association meeting will be held on January 18th at Livingston Twp hall at 7:00 p.m..

 

Diane F made a motion to allow Sue to upgrade her computer.  Seconded by Diane P and carried unanimously.
